Requirements

You must also have invested or be in the process of investing a substantial amount of capital in a U.S. business. The investment must be sufficient to ensure the success of the business and to provide a living for you and your family. Additionally, you must be coming to the U.S. to develop and direct the business.
Dependents
The E-2 dependent visa allows spouses to obtain work authorization and children under 21 to attend school in the United States. The dependent spouse does not need to apply for a separate Employment Authorization Document, it is valid with the E-2 dependent visa and upon entry into the US with that visa.
